By using these services, you agree to be bound by the terms and conditions; you agree to indemnify and hold harmless ClanHost Australia from any loss, liability, claim, damage and expense arising from or related to your content or use of any services provided by ClanHost Australia. If you are not satisfied with these terms and conditions then you must discontinue use of our hosting services.
Users who are found, beyond a doubt, to be in breach of these Terms and Conditions, will have their account status seriously reviewed, leading to either suspension, or termination of services without a refund.
ClanHost Australia are committed to cooperate with any and all legal authorities if an investigation should arise.
Hour of Support
ClanHost Australia operate between the hours of 9:00am – 9:00pm AEST. It is advised that purchases are made between these hours if you require support for your service. Although we have many fail safe’s in place, technology is not always perfect and may require our assistance to get your service up and running. If this is the case please submit a support ticket and our staff will respond to it with high priority.
ClanHost Australia does not keep a back up of customer data and it is therefore the sole responsibility of the customer to do so. ClanHost Australia recommend this is done on a regular basis to ensure that minimum data is lost in this event. ClanHost Australia hold no responsibility for such loss incurred.
You are the person or entity who is applying or who is receiving Web Hosting Services from ClanHost Australia. Use of any information obtained by way of ClanHost Australia is at your own risk, and ClanHost Australia holds no liability for such use. ClanHost Australia is not responsible for any damages arising from your use of ClanHost Australia Hosting services or by your
inability to use the Web Hosting services for any reason. You are solely responsible for maintaining data, file, and directory structure backups. You, as the customer of ClanHost Australia, are required to provide ClanHost Australia with correct and up to date contact details for billing and technical notification purposes. ClanHost Australia takes no responsibility for disruption to services due to inability to contact the customer.
You agree not to maliciously or intentionally interfere with the proper operation of the system, including but not limited to defeating identification procedures, obtaining access beyond that which you are authorized for, and impairing the availability, reliability, or quality of service for other customers. You further agree not to interfere with the proper operation of other systems reachable through the Internet, including any attempt at unauthorized access.
ClanHost Australia does not tolerate SPAM. If you use spam, unsolicited emails or message board posting, or any other similar method to promote your site, then your access to our services will be immediately terminated.
You agree that you / your site will not
- violate any state, federal or foreign laws or regulations
- infringe on any intellectual property rights (e.g. copyright, trademark, patent or other proprietary rights) of ClanHost Australia or any third party
- use defamatory, slanderous or trade libelous, threatening or harassing content of any type
- file sharing music, software, bit torrents, video or pictures that contains copyright
- use proxy server software (any type) used to hide users IP or cache content
- be discriminatory based on gender, race, age or promotes hate
- contain any type of pornography or illegal drugs or substances
- contain viruses or other computer programming defects which result in damage to ClanHost Australia, it’s servers or any third party
- The owner of this site reserves the right to delete any files hosted here for any reason.
File Hosting Terms
- You may not upload any files that violate any state, federal or foreign laws or regulations
- You may not upload any files that use defamatory, slanderous or trade libelous, threatening or harassing content of any type
- You may not upload any files, sharing music, software, bit torrents, video or pictures that contains copyright
- You may not upload any files that are discriminatory based on gender, race, age or promotes hate
- You may not upload any files that contain any type of pornography or illegal drugs or substances
- You may not upload any files that contain viruses or other computer programming defects which result in damage to ClanHost Australia, it’s servers or any third party
- The owner of this site reserves the right to delete any files hosted here for any reason.
NO RESALE OF SERVICE
You agree not to reproduce, duplicate, copy, sell, resell or exploit for any commercial purposes, lease, rent or assign any portion of the Service, use of the Service, or access to the Service, unless expressly permitted by ClanHost Australia.
Clients are not authorized to transmit unlawful, threatening, profane, pornographic, offensive, abusive, obscene, indecent or otherwise objectionable information of any kind via voice or any other means.
Rental and Game Server
In the context of this document ‘server’ means single game process.
Clients are permitted to run one game process on their server. We will include the necessary files for the chosen games upon completion of an order. The user is responsible for ensuring that they have permission to use any mods or maps used on their server. The server may not be used for commercial purposes.
You are allowed to FTP mods and maps providing they meet the requirements below.
ClanHost Australia may install third party modifications within reason. No guarantee is made as to the stability of these mods. ClanHost Australia make no guarantee any third party mod will work on our systems. ClanHost Australia strictly prohibits third party mods that use excessive resources.
Excessive amounts of resources includes but is not limited to:
CPU, RAM, Disk and Bandwidth usage
Note: Fair usage amounts are equated by examining the average usage for the same product / service type.
All game servers are setup with default out of the box settings, the only changes we make are the game ports. These ports must remain the same throughout your hosting with us.
We base our prices on Memory, Disk and CPU usage. We use the default starting map/planet/world, which should give you a high player count without reaching the memory limit. Changing/adding maps or using additional planets which create multiple processes using higher amounts of memory will most likely require you to upgrade your service.
The server may not be named offensively, in a way that reflects a commercial organization or to deliberately antagonize. The server must have all anti-cheat software turned on. ClanHost Australia believe in fair play we do not host servers for cheaters.
Game servers may not be used to host files, downloads or any web content, this includes the uploading of any files, images or software not directly associated with the running of the game processes. Any such abuse of a server will result in service being suspended and the forfeit of outstanding rental payments.
Clients will have one week notice before the end of their rental in which to renew their contract before their server is reallocated. Hence you will have the option to keep your server without any interruption to service.
ClanHost Australia provide you full FTP access to your game server files, the ability to Start/Stop/Update/Fresh Install your server. We provide you with a working server with the default server configuration files. Modify these files at your own risk. Failure to correctly configure these files may result in the server not functioning correctly. For more information on how to configure a server please read the user guide, forums or WIKI supplied by the games creator/manufacture.
We DO NOT backup your game server, however using the right tools you have access to back it up yourself. If you require a restore, contact us and we may have one on record.
ClanHost staff may enter your server at any time password protected or not. This allows the staff to check how well the server is running.
You may not increase the player limits on your server (this includes spectators) without the prior permission of ClanHost Australia and payment of the difference in rental prices. We are unable to offer refunds to clans who wish to reduce player numbers for any reason. Slot are now UNLIMITED.
Limitation of liability
ClanHost Australia will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, or data in relation to your use of the server.
It is the customer’s duty to keep ClanHost Australia informed of any changes of personal details. This includes and it not limited to your email address, address and telephone number. Your new personal details must be sent three days prior to any new communication being sent to the customer. E-mail is the preferred contact method for general communique. ClanHost Australia will not be held responsible for any loss of communication or problems that arise as a result of customers not informing ClanHost Australia of their current and accurate contact details.
Security of your Personal Information
We will take reasonable steps to ensure that the personal information we collect, use or disclose is accurate, complete, up-to-date and stored in a secure environment protected from unauthorized access, modification or disclosure.
How to access your Personal Information Upon your request, ClanHost Australia will take reasonable steps to let you know, generally, what sort of personal information we hold, for what purposes and how we collect, use and disclose that information.
Upon your request, ClanHost Australia will provide access to your personal information we hold, except in certain prescribed circumstances, including emergency situations, specified business imperatives and law enforcement or other public interests.
Quality of service
We aim to provide best possible service at best possible prices. We offer comprehensive support via many options found by clicking the Support link. Our online team play a key role in providing a quality service to you. This quality of service can only be expected if these Terms of Service are adhered to.
Faults, Downtime and Errors
The User accepts that there may occasionally be problems with computers and telecommunication systems. Consequently the User accepts that there may be periods of downtime, relating to the Services and/or Web Site, in which the User cannot access these. However, we will maintain reasonable effort to minimize these periods. The User accepts that in such cases of downtime, they will have no claim of breach of contract. When possible We will notify the User of predicted downtime and/or scheduled downtime for upgrades, updates, etc.
Pricing / Payments / Refunds
All prices on the website may change at any given time. When you purchase your hosting plan this price will remain the same unless a general price increase is implemented or you decide to upgrade or downgrade your package.
The customer is responsible for canceling any PayPal subscriptions upon service termination or cancellation. Any over-payments to ClanHost Australia may be refunded if requested by the Client within 48-hours of the over-payment, otherwise the amount will be applied to the customer’s credit balance and may not be refunded.
The minimum rental period is 1 calendar month and the rental fee is non-refundable. When your server has been paid for in full, we will complete your order. Your rental period will not start until the day we give you access to your server.
Refunds to clients that are unable to configure their server correctly, change setting and install modifications / plugins will not be entitled to a refund. It is the clients responsibility to research on how to do this before proceeding to purchase a game server.
Refunds for change of mind on a product that you have purchased, we are happy to offer an exchange or credit your ClanHost Australia account, provided the product is cancelled within 24 hours of the invoice date.
ClanHost Australia will under no circumstance be liable for indirect, special, or consequential damages including any loss of business, revenue, profits, fees, or data in relation to your use of the service.
We reserve the right to change these rules and guidelines at anytime without prior notice.
